5. How and why we use your personal information
UK data protection law requires us to have a lawful basis for processing personal information.
Depending on the circumstances, we rely principally on:
- Contract, where processing is necessary to enter into or perform a contract with you, such as processing and delivering an order.
- Legal obligation, where we need to process information to comply with a legal requirement.
- Legitimate interests, where processing is necessary for our legitimate business interests or those of another party and those interests are not overridden by your rights and interests.
Where we rely on legitimate interests, those interests include operating and improving our business, administering customer and Fizzbassador relationships, providing customer service, understanding the performance of our products and marketing, responding to enquiries, preventing fraud and misuse, protecting our systems, and establishing and developing commercial relationships. We consider whether the processing is necessary and proportionate and balance our interests against your rights and interests.
- Consent, where you have given us permission for a particular use, such as certain marketing or the use of certain cookies and advertising technologies. Where we rely on consent, you can withdraw it at any time.
Our principal processing activities are:

6. Customers and online purchases
Customers will be able to purchase alcoholic products through our website.
When you make a purchase, we may collect information necessary to process the transaction, confirm eligibility to purchase our products, take payment, deliver your order, communicate with you about the order and deal with returns, refunds or customer service issues.
Our ecommerce platform is Shopify. Payment methods may include Shopify supported payment services, PayPal, bank transfer and other payment methods made available from time to time.
Payment providers process certain payment information independently or on our behalf according to their own roles and privacy terms.
We may fulfil orders ourselves or use third party fulfilment providers, warehouses and delivery companies. These organisations will receive information required to fulfil and deliver orders, such as your name, delivery address and, where necessary, contact details.
7. Fizzbassadors
We operate or intend to operate a Fizzbassador programme through which eligible adults may apply to receive products, participate in product testing, create content, provide feedback or otherwise work with the FizzBomb brand.
We may collect:
- full name
- date of birth
- email address
- telephone number where provided
- delivery address
- social media handles
- university
- relevant clubs and societies
- application information
- communications with us
- and content created or submitted as part of the programme
We use this information to assess applications, verify eligibility, select participants, communicate with applicants, send products, administer the programme, understand the reach and performance of the programme, and maintain appropriate records.
Applying to become a Fizzbassador does not automatically mean that you have consented to receive unrelated direct marketing from us.
Where marketing consent is required, we will request it separately.
We may receive Fizzbassador applications through our website, email, TikTok, Instagram and other channels.
8. Age verification
Our alcoholic products are intended only for people who are legally permitted to purchase or receive them.
We may ask for your date of birth, confirmation that you are 18 or over or other information necessary to establish or verify your age.
We may use a third party age verification provider where appropriate.
Where practical, we aim to retain confirmation that an age check has been completed rather than retaining copies of identity documents.
If additional verification is required, we will only use information obtained for age verification for appropriate purposes and will seek to minimise the information retained.
9. Competitions, surveys, sampling and events
We may collect personal information when you:
- enter a competition or giveaway;
- participate in a survey or research project;
- request or receive product samples;
- attend or participate in an event; or
- provide feedback about our products.
We use this information to administer the relevant activity, communicate with participants, deliver prizes or products, conduct research, understand customer preferences and improve our products and marketing.
Where we want to use information for a purpose that requires consent, we will ask for that consent separately.
10. Social media
If you interact with Bevi or FizzBomb through social media, we may receive information such as your username, profile information, messages, comments, content and other information you choose to provide.
Social media platforms also process information independently under their own privacy policies.
We may retain relevant communications where necessary to manage Fizzbassador relationships, respond to enquiries, maintain records, administer promotions or protect our legitimate business interests.
11. Marketing communications
We may send information about FizzBomb, Bevi, our products, launches, offers, events and other promotions by email, SMS, social media direct message, WhatsApp or other electronic communication channels.
Where consent is required, we will ask for it.
Consent to one marketing channel does not necessarily constitute consent to another. For example, where required, consent to receive marketing emails will not automatically constitute consent to receive marketing by SMS.
In some circumstances, UK electronic marketing rules allow us to market our own similar products to existing customers without separate consent where the relevant requirements of the "soft opt in" are met. This includes giving the person a clear opportunity to opt out when their details are collected and in each subsequent marketing communication.
You can unsubscribe or object to direct marketing at any time using the unsubscribe mechanism provided in the communication or by contacting us.
We may retain limited information about people who have unsubscribed so that we can respect their preference and avoid marketing to them again.
12. Cookies, analytics and advertising
Our website uses, or may use, cookies, pixels and similar technologies.
These technologies may be used to:
- operate the website and shopping basket;
- remember preferences;
- understand website usage;
- measure website performance;
- understand how people find and interact with our website;
- measure advertising performance; and
- show or measure relevant advertising.
Our services may use technologies provided by organisations including Shopify, Google, Meta and TikTok. We may add or change providers as our website and marketing activities develop.
Where required by law, nonessential cookies and similar technologies will not be used until you have provided the required consent.
You will be able to manage applicable choices through our website's cookie controls.
We may also provide a separate Cookie Policy containing further information about the technologies in use.
13. Sharing personal information
We may share personal information where reasonably necessary with:
- Ecommerce and website providers, such as Shopify.
- Payment providers, such as payment services available through Shopify, PayPal and other payment providers.
- Warehousing and fulfilment providers, including third party logistics providers and, where applicable, Amazon related fulfilment or shipping services.

- Regulators, government authorities, courts, law enforcement agencies and other authorities, where disclosure is required or permitted by law.
- Potential purchasers, investors and transaction advisers, where necessary in connection with investment, financing, restructuring, sale of assets, merger, acquisition or sale of all or part of our business.
We require service providers processing personal information on our behalf to handle that information appropriately and in accordance with applicable data protection requirements.
We do not sell your personal information merely because you interact with Bevi or FizzBomb.
14. International transfers
Some organisations that provide technology, ecommerce, analytics, advertising, communications or other services to us may process personal information outside the United Kingdom.
Where a transfer of personal information outside the UK is subject to UK data protection restrictions, we will use an appropriate lawful transfer mechanism.
Depending on the destination and recipient, this may include UK adequacy regulations or appropriate contractual and other safeguards recognised under UK data protection law.
You may contact us if you would like further information about the safeguards applicable to your personal information.
15. How long we retain personal information
We do not keep personal information for longer than reasonably necessary for the purposes for which it was collected, including satisfying legal, accounting, regulatory and reporting requirements and establishing or defending legal claims.
Our expected retention periods are generally:
| Information | Typical retention period |
|---|---|
| Customer, order and transaction records | Generally 6 years after the relevant transaction or end of the relevant relationship |
| Successful Fizzbassador records | Duration of relationship and generally up to 3 years afterwards |
| Unsuccessful Fizzbassador applications | Generally up to 12 months |
| Marketing subscriber information | While subscribed or otherwise eligible to receive marketing; suppression information may be retained afterwards as necessary |
| Competition and giveaway information | Generally up to 12 months after completion, unless required longer |
| Identifiable survey and research information | Generally up to 24 months, with information anonymised where practical |
| Customer service correspondence | Generally up to 3 years after resolution |
| Age verification information | Only for as long as reasonably necessary, with data minimised where practical |
| Investor and general business enquiries | Generally up to 3 years after the last meaningful contact, unless a relationship develops |
| Accounting and tax records | Generally 6 years or for any longer period required by law |
These periods are guidelines. We may retain information for a shorter or longer period where appropriate because of legal requirements, disputes, complaints, fraud prevention or other legitimate reasons.
Where information is no longer required, we will delete or anonymise it as appropriate.
16. Security
We take reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.
Personal information may be stored within systems including our ecommerce platform, Google Workspace, cloud storage, business computers, spreadsheets and other systems used to operate Bevi.
Access to personal information should be limited to people who need it for legitimate business purposes.
No internet based service or storage system can be guaranteed to be completely secure. We therefore continually consider appropriate measures having regard to the nature of the information and risks involved.
17. Your rights
Depending on the circumstances, UK data protection law gives you rights in relation to your personal information.
These may include:

- The right of access to personal information we hold about you.
- The right to rectification of inaccurate or incomplete information.
- The right to erasure of your personal information in certain circumstances.
- The right to restrict processing in certain circumstances.
- The right to data portability in certain circumstances.
- The right to object to certain processing based on legitimate interests.
- The right to withdraw consent at any time where processing is based on your consent.
You also have rights relating to certain forms of automated decision making and profiling.
These rights are not absolute and their application depends on the circumstances and lawful basis involved.
Your right to object to direct marketing
You have the right to object to the use of your personal information for direct marketing at any time.
If you tell us that you do not want to receive direct marketing through a particular channel, we will stop using your personal information for that marketing as required.
To exercise your rights, contact us at fizzbombuk@gmail.com.
We may need to request information to confirm your identity before fulfilling certain requests.
18. Children and age restrictions
FizzBomb and Bevi alcoholic products are intended for adults aged 18 and over.
We do not intend to sell or supply alcoholic products to anyone under 18.
The Fizzbassador programme involving alcoholic products is also intended for people aged 18 and over.
If we become aware that we have collected personal information from someone under 18 in circumstances where we should not have done so, we will take appropriate steps to address this.
19. Automated decision making
We may use technology to assist with activities such as fraud prevention, age verification, website analytics, advertising and customer segmentation.
We do not currently intend to make decisions about individuals based solely on automated processing where those decisions produce legal or similarly significant effects, unless permitted by law and appropriate safeguards are in place.
If this changes, we will update the information we provide as appropriate.
20. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our business, technology, service providers, data processing practices or legal requirements.
The latest version will be made available through our website and the date at the top of this Privacy Policy will indicate when it was last updated.
Where a change materially affects how we use personal information, we will take appropriate steps to bring that change to the attention of affected individuals before undertaking new processing where required.
